Employment Practices Liability (EPLI)
Definition
Employment practices liability insurance (EPLI) covers claims by employees, former employees or job applicants alleging wrongful treatment, such as discrimination, harassment, wrongful termination or retaliation. It pays defense costs and settlements, which general liability policies typically exclude.
In Plain English
Even a business with a handful of employees can face these claims. Hotels, apartment communities and convenience stores often have many front-line staff and steady turnover, which adds exposure. Many EPLI policies can also add third-party coverage for claims by tenants, guests or customers, such as harassment or discrimination by staff.
EPLI is usually written on a claims-made basis with a retroactive date, and defense costs usually reduce the limit. Most policies carry a self-insured retention or deductible you pay first. Wage-and-hour claims are commonly excluded or sharply limited.
Many insurers offer hotlines with employment lawyers and HR resources. Written policies, training and consistent records of discipline help prevent claims and help defend them.

Example
Hypothetical and simplified: A motel's former night manager claims she was fired for reporting harassment. Defending the claim through mediation costs $60,000, and it settles for $40,000. An EPLI policy with a $25,000 retention may pay the remaining $75,000, subject to its terms.
What to Watch For
- Ask whether the policy includes third-party coverage for claims by tenants, guests or customers.
- Check how wage-and-hour claims are treated.
- Report claims and demand letters immediately, because claims-made policies have strict reporting rules.
- Keep a written employee handbook and apply it consistently.
Common Questions
I only have a few employees. Do I need EPLI?
Small employers do receive these claims, and defending even an unfounded one can be costly. Whether to buy it depends on your staff size, turnover and budget, so it's worth getting a quote to compare.
Does EPLI cover unpaid wage or overtime claims?
Usually not, or only defense costs under a small sublimit. Check the policy's wage-and-hour wording.
