Lender Insurance Requirements (Loan Insurance Requirements)

Definition

Lender insurance requirements are the insurance terms a lender sets as a condition of a commercial real estate loan. They usually cover the type and amount of property coverage, deductibles, liability limits, flood, rent loss and how the lender must be named on the policy.

In Plain English

Your loan documents and the lender's insurance checklist spell out what you must carry. Common items include replacement cost coverage, wind and hail, liability limits, an umbrella, and rental income coverage. Lenders often cap deductibles and set a minimum financial strength rating for the insurer.

The lender must also be shown correctly on the policy. That is usually done with a mortgagee clause on the property policy, or a lender's loss payable endorsement, with the lender's exact name and address. Proof is commonly sent on an ACORD 28 evidence of property insurance, plus a certificate for liability.

Requirements differ by lender type. Banks, life companies and agency lenders each have their own standards, and CMBS insurance requirements are often the most detailed. Requirements also reach your renewals, so a change in deductibles or coverage at renewal can trigger a lender review.

Example

Hypothetical: a lender requires a deductible no higher than $25,000 and 12 months of rent loss. The owner's renewal quote has a 2% wind deductible on a $3,000,000 building, which is $60,000. Before binding, the owner asks the lender whether it will accept the higher wind deductible or looks for a lower deductible option.

Why It Matters for Texas Property Owners

Federal law requires flood insurance on buildings in high-risk flood zones that secure loans from federally regulated or insured lenders. In the Houston area and along the coast, lenders also look closely at named storm and wind deductibles and may require TWIA or other wind coverage where the main policy excludes wind.

What to Watch For

  • Get the lender's written insurance requirements before you request quotes.
  • Compare deductibles, limits, flood, rent loss and carrier ratings line by line against the quote.
  • Use the exact lender name, loan number and mailing address from the loan documents.
  • Send renewal evidence to the lender before expiration to avoid force-placed insurance.

Common Questions

What happens if I don't meet my lender's requirements?

The lender may treat it as a loan default or buy its own coverage, called force-placed insurance, and charge you. It is usually better to ask the lender for a written waiver than to ignore a gap.

Can I negotiate my lender's insurance requirements?

Sometimes. Lenders may accept a higher deductible or different terms when the market makes a requirement hard to meet, but get any change in writing.
