Storage Tank Liability Insurance (Tank Insurance)
Definition
Storage tank liability insurance covers cleanup costs and third-party claims from leaks of fuel or chemicals from underground or aboveground storage tanks. For petroleum tank owners, it is a common way to meet federal and Texas financial responsibility rules.
In Plain English
Gas stations and other sites with a regulated underground storage tank must show they can pay for a leak's cleanup and harm to others. Tank insurance is one way to do that. It typically covers corrective action (cleanup), third-party bodily injury and property damage, and legal defense, up to its limits.
Federal rules set the minimum amounts. Per occurrence, it is $1 million for petroleum marketers or tanks handling more than 10,000 gallons a month, and $500,000 otherwise. The annual aggregate is $1 million for 1 to 100 tanks and $2 million for 101 or more.
Policies are often claims-made, so prompt reporting and continuous coverage matter. Tank coverage doesn't replace broader pollution legal liability, which can address other pollution at the site.

Example
Hypothetical and simplified: a convenience store with 3 underground tanks sells 150,000 gallons of fuel a month. As a petroleum marketer, the owner needs at least $1 million per occurrence and a $1 million annual aggregate in financial assurance. A tank liability policy with those limits that meets the rules could satisfy the requirement.
Why It Matters for Texas Property Owners
In Texas, the TCEQ administers these rules (30 TAC Chapter 37, Subchapter I). Owners show proof through an annual self-certification, and coverage does not transfer when a property is sold — the buyer needs its own. See TCEQ financial assurance.
What to Watch For
- Confirm your per occurrence and aggregate limits meet the federal minimums for your tank count and fuel volume.
- Keep your annual self-certification with TCEQ current.
- When buying a gas station, arrange new coverage before closing, since the seller's coverage won't transfer.
- Ask whether the policy covers unknown prior leaks, and what its retroactive date is.
Common Questions
Is tank insurance required by law?
Owners and operators of regulated petroleum underground storage tanks must show financial responsibility. Insurance is a common way to do it, though the rules allow other methods too.
If I buy a gas station, does the seller's tank policy cover me?
No. Coverage does not transfer on a sale, so the buyer needs to put its own financial assurance in place.
