TCEQ Financial Assurance (Financial Responsibility for Storage Tanks)
Definition
TCEQ financial assurance is the Texas requirement that owners or operators of petroleum underground storage tanks prove they can pay to clean up leaks and compensate others harmed. Most owners meet it with storage tank liability insurance. Federal rules set minimums of $500,000 or $1 million per occurrence.
In Plain English
The amounts come from federal rule 40 CFR 280.93. Petroleum marketers, or tanks handling more than 10,000 gallons a month, need $1 million per occurrence; others need $500,000. The annual aggregate is $1 million for 1 to 100 tanks and $2 million for 101 or more.
TCEQ administers this in Texas. Owners usually meet it by buying storage tank liability insurance and completing an annual self-certification. Other approved methods exist but are less common for small owners.
Coverage does not transfer when a property is sold. A buyer needs its own financial assurance in place at closing, and the seller's policy may need to stay in force for past leaks.

Example
Hypothetical: a family-owned gas station with four underground tanks sells about 60,000 gallons a month. As a fuel retailer, it needs $1 million per occurrence and a $1 million annual aggregate, which the owner meets with a tank liability policy and an annual self-certification.
Why It Matters for Texas Property Owners
Rules are in 30 TAC Chapter 37, Subchapter I. Inspectors check proof of financial assurance, and gaps can lead to enforcement and trouble getting fuel deliveries.
What to Watch For
- Confirm your tank policy limits meet the per-occurrence and aggregate minimums for your tank count.
- Complete the annual self-certification and keep it on site.
- Keep the original insurance document, worded as TCEQ rules require; TCEQ says ACORD certificates are not acceptable proof.
- On a purchase, line up new tank coverage effective at closing.
- Check whether the policy is claims-made and what the retroactive date is.
Common Questions
Does my regular property or general liability policy meet TCEQ financial assurance?
Usually not. Most general liability and property policies exclude pollution, so tank owners typically buy a separate storage tank liability policy built to meet the requirement.
If I buy a gas station, does the seller's tank insurance cover me?
Generally, no. Financial assurance coverage generally does not transfer on a sale, so you need your own coverage in place as of closing.
